Terms of Service

1. The service

RenterCheck (backgroundcheck.pl, "we", "the service") lets registered users write reviews about other people (typically tenants or landlords) and look up whether a given PESEL has any reviews attached to it, in exchange for a paid token or a bundle of tokens. By creating an account or using the service, you agree to these Terms and to our Privacy Policy.

2. Eligibility and your account

You must be at least 18 years old and provide accurate registration information, including your own PESEL. One PESEL may be tied to one account; creating multiple accounts to evade a restriction (such as a blocked review, an invalidated one, or a rate limit) is a breach of these Terms and may result in suspension.

You're responsible for keeping your password confidential and for all activity under your account.

3. Reviews you post

A review must be truthful, based on your genuine first-hand experience with the person it describes, and free of unlawful content (defamation, hate speech, threats, or content that violates a third party's rights). You may not review yourself, and you may not post a second review about the same person while an earlier valid review of yours about them still stands.

You may edit or retract your own review at any time via your account, unless it is currently under appeal or already invalidated. Retracting a review marks it invalid rather than deleting it outright, so appeal history is preserved.

You are solely responsible for the content of your reviews. We are a hosting platform for user-generated content, not the author, and do not independently verify factual claims in a review before publication.

4. Appeals

If a review is written about you, you may appeal it. An appeal puts the review under review by us; while pending, the reviewed content is flagged as "under appeal" and cannot be edited or retracted by its creator. We decide appeals at our reasonable discretion based on the evidence provided by both sides.

5. Payments, tokens, and lookups

Lookups are paid for either with a token from a bundle you've purchased or with a one-off card payment, processed by Stripe. We only charge you, or spend a token, once we know whether the lookup returns a result — a lookup that finds nothing is free.

Token bundle prices and sizes are shown at time of purchase and may change going forward; a bundle you've already bought keeps its original terms. Purchases are generally non-refundable once a lookup has been performed, except where required by applicable consumer-protection law (in Poland, note that the statutory 14-day withdrawal right for digital content does not apply once you've consented to immediate performance and acknowledged the loss of that right, which purchasing a lookup constitutes).

You may not use a lookup you didn't pay for, attempt to check your own PESEL (blocked automatically), or circumvent rate limits.

6. Prohibited conduct

In addition to the above, you agree not to: scrape or bulk-extract data from the service; attempt to bypass authentication, rate limits, or payment; use another person's account without permission; or use the service to harass, discriminate against, or unlawfully profile anyone.

7. Suspension and termination

We may suspend or terminate an account that breaches these Terms, with or without notice depending on severity. You may delete your own account at any time from Settings; see our Privacy Policy for exactly what is and isn't erased when you do.

8. Disclaimer and liability

Reviews reflect the opinions of the users who wrote them, not our own findings, and we make no guarantee as to their accuracy. The service is provided "as is"; to the maximum extent permitted by law, we are not liable for decisions you make based on content you read here, nor for indirect or consequential losses. Nothing in this section limits liability that cannot be excluded under Polish law, including liability for intentional harm.

9. Governing law and changes

These Terms are governed by Polish law. We may update these Terms from time to time; material changes will be highlighted on the site, and continued use after they take effect constitutes acceptance. Questions: legal@backgroundcheck.pl.
